Hill has started a legal battle against the Executive Office for U.S. Attorneys accusing them of obstructing Justice, which is a felony offense under 18 U.S. Code ยง 1519 - Destruction, alteration, or falsification of records in Federal investigations and bankruptcy. Brian D. Hill, formerly of USWGO Alternative News, has filed a FOIA Request for the entire discovery packet of evidence that was originally used against him in his Federal criminal case, for the sole purpose of aiding him in proving his Actual Innocence, via Affirmative Defense of "Frame Up". He has to prove that he was framed with child porn in order to be found Not Guilty by a Judge or Jury, even on technical possession since the authorities claimed that it was found on his computer. Brian must either prove that they lied or that they, or somebody else, framed him with CP. The U.S. Attorney Office through the Executive Office for U.S. Attorneys (EOUSA) has mailed a response which contains alleged false information that "0 records are withheld in full (WIF)". A 4-witness signed Federal Declaration/Affidavit, and other evidence shows that records were withheld secretly which violates Brian's rights under FOIA and his rights as a criminal Defendant to prove his Actual Innocence (Due Process clause, right to a effective lawyer, 14th Amendment, U.S. Constitutional rights). Brian is fighting in his appeal to compel the U.S. Attorney to turn over the missing records concerning Brian's criminal case discovery evidence, or to acknowledge that they purged evidence records which may be favorable to the Defense in order to prevent Brian from proving to a Jury that he was framed with CP
